Estate management and Will wording

It’s important to use the correct wording and legal names when making a gift in your Will to ensure that it can be used as you intended. Arts Centre Melbourne recommends the following wording for your nominated gift:

Residuary Bequest

I give, devise and bequeath to the Victorian Arts Centre Trust (ABN 83 295 983 059), or its legal successor:

  • the whole of my estate
  • ______ [insert number] percent of my estate
  • the residue of my estate
  • ______[insert number] percent of the residue of my estate
  • the sum of $ [insert value of your gift]
  • if you wish to give an asset eg property or shares: [insert description of property] or [insert number] of my [insert name of shares] shares.

free of all duties and testamentary expenses to the Victorian Arts Centre Trust for its general purposes and I direct that the receipt of that organisation shall be sufficient discharge to my executors for this bequest.

Specific Purpose

I give devise and bequeath to the Victorian Arts Centre Trust (ABN 83 295 983 059), or its legal successor:

  • the whole of my estate
  • ______ [insert number] percent of my estate
  • the residue of my estate
  • ______[insert number] percent of the residue of my estate
  • the sum of $ [insert value of your gift]
  • if you wish to give an asset eg property or shares: [insert description of property] or [insert number] of my [insert name of shares] shares.

free of all duties and testamentary expenses to the Victorian Arts Centre Trust for its own use absolutely and I direct that the receipt of that organisation shall be sufficient discharge to my executors for this bequest and I declare it is my wish but without imposing any legal obligation on the Victorian Arts Centre Trust that the monies arising from this bequest be used and applied by the Victorian Arts Centre Trust

*Additional wording for directed gifts:

to be directed to Arts Centre Melbourne’s Endowment Fund for the specific purpose of:

  • supporting community access and education programs
  • supporting the Australian Performing Arts Collection
  • supporting artists and the development of Australian works
  • supporting performing arts mental health and wellbeing, including through the Arts Wellbeing Collective
  • supporting performing arts industry training, including through the Registered Training Organisation

If you are creating a Will or updating it, we suggest you consult a legal adviser to ensure that your Will is valid and your wishes are expressed correctly. It may be helpful to your legal adviser, State or Public Trustee or Trustee Company to have reference to our suggested wording above when updating your Will. If you do not have a solicitor, you can consult the Law Institute of Victoria to find a solicitor in your area who specialises in Wills and Estates.
